1. Introduction
By using Cims, sempre amunt, you confirm your acceptance of, and agree to be bound by, these terms and conditions.
2. Agreement to Terms and Conditions
This Agreement takes effect on the date on which you first use the Cims, sempre amunt application.
3. Cims and optional Pro subscriptions
Cims is an outdoor activity and community app. Pro is an optional recurring subscription supporting Cims. When Pro launches, it will allow subscribers to create private plans, make public plans private, and download their summit history as CSV. Existing private plans remain private and editable after Pro ends. Other app features remain available without Pro.
Pro is purchased in the iOS or Android app through Apple App Store or Google Play. EUR reference prices are €1.99 per month or €9.99 per year; your store shows the localized total and billing interval before confirmation. Annual subscriptions are billed upfront. Subscriptions renew automatically until cancelled. There is no free trial. Apple or Google handles payment details.
Manage or cancel renewal in the store where you subscribed. Cancellation normally preserves access through the paid period; refunds, revocations and any store-confirmed grace period may affect access. Deleting Cims does not cancel an Apple subscription: cancel it in App Store settings before deleting your account. Cims stops Google Play renewal during account deletion. If that request fails, deletion is postponed to avoid leaving renewals active.
4. Refunds and withdrawal
To request a refund or exercise a statutory withdrawal right, contact [email protected] with the email used for your subscription. Cancelling renewal does not itself issue a refund. Nothing in these terms excludes mandatory consumer rights, including any applicable cooling-off period or remedies for services that do not conform to the contract.
5. Disclaimer
It is not warranted that Cims, sempre amunt will meet your requirements or that its operation will be uninterrupted or error-free. All express and implied warranties or conditions not stated in this Agreement (including, without limitation, loss of profits, loss or corruption of data, business interruption, or loss of contracts), insofar as such exclusion or disclaimer is permitted under applicable law, are excluded and expressly disclaimed. This Agreement does not affect your statutory rights.
6. Warranties and Limitation of Liability
Cims, sempre amunt does not provide any warranty, guarantee, or other assurance regarding the quality, fitness for purpose, or other aspects of the software. Cims, sempre amunt shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition, or other term, or any duty at common law, for any loss of profit or any indirect, special, or consequential loss, damage, costs, expenses, or other claims (whether caused by Cims, sempre amunt`s negligence, its employees, or agents) that arise out of or in connection with the provision of any goods or services by Cims, sempre amunt.
Cims, sempre amunt shall not be liable or deemed to be in breach of contract due to any delay in performing, or failure to perform, any of its obligations if the delay or failure was caused by circumstances beyond its reasonable control. Notwithstanding any contrary clauses in this Agreement, in the event that Cims, sempre amunt is deemed liable to you for a breach of this Agreement, you agree that Cims, sempre amunt`s liability is limited to the amount actually paid by you for its services or software. You hereby release Cims, sempre amunt from any and all obligations, liabilities, and claims exceeding this limitation.
7. Responsibilities
Cims, sempre amunt is not responsible for how users interact with or use user-generated content within the platform.
8. Price changes
Any change to your subscription price will be communicated before it takes effect, with the opportunity to cancel renewal. The amount already paid for the current billing period is not changed.
9. General Terms and Governing Law
This Agreement is governed by the laws of Spain. You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and Cims, sempre amunt as a result of your use of these services. You agree not to present yourself as a representative, agent, or employee of Cims, sempre amunt. You also agree that Cims, sempre amunt will not be liable for any representation, act, or failure to act on your part.
10. Data and Automated Access
The peak catalogue, trails, photos and community content on the website, the app and its API are not licensed for extraction. You may not scrape, crawl, bulk download or otherwise collect them by automated means, including AI agents, nor use them to train or fine-tune AI models, without our written permission. Cims, sempre amunt reserves text and data mining rights under Article 4(3) of Directive (EU) 2019/790. Reading, linking to, quoting and recommending individual pages is welcome.
11. Uploaded Photos and Cims Promotions
You retain ownership of the photos you upload to Cims. By uploading a photo after accepting these revised terms, you grant Cims a non-exclusive, worldwide, royalty-free licence to store, reproduce, distribute, publicly display, communicate and adapt that photo to operate the service and to promote the Cims brand, app, products, services and community. The licence covers each photo you actually upload, not other works you may create. Photos uploaded before you accept these terms require separate permission for promotional use.
Promotional uses include Cims websites and app listings, social media posts, paid advertising, email campaigns, videos, press materials and printed promotional materials. Cims may crop, resize, adjust colours, add text or branding, and combine photos with other content for these purposes, respecting your moral rights, including authorship and the integrity of your work. No royalties or other payment are due for these licensed uses, except where required by law.
Cims may sublicense these rights to hosting providers, social media and advertising platforms, printers and creative agencies only as needed to deliver these services or Cims campaigns. This licence does not allow them to use your photos for unrelated brands or independently sell them as stock photography.
You must own the photo or have authority to grant this licence and have the permissions needed to upload it. A copyright licence does not replace anyone's privacy or image rights. Before using a photo of an identifiable person in a promotion, Cims must obtain any legally required, separate permission from that person or their legal representative. Uploading a photo or accepting these terms does not by itself constitute consent to the use of someone's personal data or likeness in marketing. Refusing or withdrawing that consent does not affect access to the app.
The licence lasts for the duration of the applicable copyright, subject to the following termination rights and mandatory law. Deleting the photo or your account, or contacting [email protected], ends the licence for new promotional uses of that photo. Cims will also remove it from ongoing promotions under its control within a reasonable time. Printed materials already distributed and copies independently shared by others may not be recoverable. This does not limit any legal right to erasure, withdrawal of consent or other remedy, and retained copies may not be used for new promotions.
See our Privacy Policy for information about photo processing, consent and privacy requests.
